Terms of Service

These terms govern your use of Zexci, operated by PNS Communications, LLC ("Zexci", "we", "us"). By using Zexci you agree to them.

Acceptance of these terms

By creating an account, scanning a Zexci code, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Zexci.

Eligibility & accounts

You must be an adult and able to form a binding contract. [ATTORNEY: confirm minimum age + jurisdiction limits.] You're responsible for your account and for the accuracy of the information you provide. One account per person. Accounts are personal and may not be sold, shared, or transferred.

The service

Zexci lets you scan verified ad codes ("QRV codes") and earn Zexci Points through Zexci Rewards, which you can redeem for gift cards in the app. This website is informational; rewards activity happens in the Zexci app.

Acceptable use

You agree not to: misuse or interfere with the service; attempt to earn rewards through means other than genuine scans; create multiple or fake accounts; use bots, automation, emulators, or other manipulation; misrepresent your identity; or violate any law. We may refuse, suspend, or terminate service for any of these.

Rewards eligibility & anti-abuse

Rewards are a privilege offered at Zexci's discretion, not a guaranteed entitlement. To protect the program and other users, Zexci reserves the right to:

• require identity verification (which may include a phone number, and a tax identifier such as an SSN at the legal reporting threshold) as a condition of earning or redeeming;
• review, hold, delay, withhold, reduce, or revoke rewards where we detect or reasonably suspect fraud, abuse, multiple/duplicate accounts, or a violation of these Terms;
• refuse, suspend, or terminate service and close accounts engaged in such activity; and
• take these steps in our reasonable discretion.

Zexci uses a range of anti-fraud and verification measures and enforces them. We don't publish the details of those measures. Rewards obtained through fraud or abuse are void.

Text messages (SMS)

If you provide a mobile number you consent to receive verification and transactional texts from Zexci. Message and data rates may apply; reply STOP to opt out, HELP for help. See the Privacy Policy for details. [ATTORNEY: confirm A2P/SMS consent terms.]

Intellectual property

Zexci, the Zexci shield, "SAFE-SCAN VERIFIED", QRV, Zexci Points, Zexci Rewards, and Zexci Pulse are marks of PNS Communications, LLC. The QRV technology and the Zexci Rewards method are covered by U.S. Patents 9,204,060 and 9,342,838. You receive no rights in our marks or technology except to use the service as intended. Third-party destinations

Scanning may take you to an advertiser's destination. Zexci verifies that a code is genuine and where it leads, but we don't control third-party sites or offers and aren't responsible for them.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. [ATTORNEY: finalize warranty disclaimer.]

Limitation of liability

To the fullest extent permitted by law, Zexci is not liable for indirect, incidental, or consequential damages, and our total liability is limited. [ATTORNEY: finalize liability cap + carve-outs.]

Termination

You may stop using Zexci anytime. We may suspend or terminate access — including for the anti-abuse reasons above — and unredeemed Zexci Points may be forfeited on termination for cause.
